Welcome to RylaxYacht.com. By accessing this website or booking a charter with Rylax Yacht Charters, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Use of Website

This website is intended for informational and booking purposes only. You agree not to use the site for any unlawful, harmful, or unauthorized purpose.

2. Charter Bookings

All charter bookings are subject to availability and confirmation. 13 people max for a charter.

Prices are subject to change and do not include gratuity or provisions. A deposit may be required to secure a reservation.

Final payment is due prior to charter.

Cancellations may be subject to fees or forfeiture of deposit based on timing. Weather-related cancellations are at the discretion of the captain and will be rescheduled when possible.

3. Assumption of Risk

Guests participating in yacht activities do so at their own risk. Water activities (e.g., jet skiing, sliding, snorkeling) involve inherent risks and require all guests to follow crew instructions and safety protocols.

4. Limitation of Liability

Rylax Yacht Charters, its owners, affiliates, crew, and representatives shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of this website or participation in charters.

5. Indemnification

You agree to indemnify, defend, and hold harmless Rylax Yacht Charters, its affiliates, owners, crew, and representatives from and against any and all claims, losses, liabilities, expenses, damages, and costs (including legal fees) resulting from:

Your breach of these terms
Your participation in activities during the charter
Any violation of applicable law
Any harm or injury caused by your actions or those of your guests

6. Intellectual Property

All content on this website, including images, text, logos, and branding, is the property of Rylax Yacht Charters and may not be used or reproduced without written permission.

7. Privacy

Please refer to our Privacy Policy for information on how your data is collected and used.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Florida. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

9. Modifications

We reserve the right to update these Terms and Conditions at any time. Continued use of the website and charter services constitutes acceptance of the updated terms.

* U.S. Coast Guard Compliance

1. Passenger Capacity: Rylax Yacht is certified as a Small Passenger Vessel (SPV) under USCG regulations, allowing it to carry up to 13 passengers for hire. This limitation ensures adherence to safety standards and legal requirements.

2. Licensed Crew: All operations are conducted by a captain holding a valid USCG Merchant Mariner Credential appropriate for the vessel's size and service. This credential ensures that the captain meets the necessary qualifications and training standards.

3. Vessel Inspection: The yacht undergoes regular USCG inspections to maintain its Certificate of Inspection (COI), verifying that it meets all safety and operational standards required for passenger vessels.

4. Safety Equipment: Rylax Yacht is equipped with all mandatory safety gear, including USCG-approved life jackets, fire extinguishers, visual distress signals, and other necessary equipment to ensure passenger safety.

Florida State Regulations

1. Fishing Activities: If fishing is part of the charter experience, Rylax Yacht holds the appropriate Florida Fish and Wildlife Conservation Commission (FWC) Charter Captain or Charter Boat license, allowing guests to fish without individual licenses.

2. Crew Fishing Restrictions: Crew members are prohibited from harvesting certain species, such as red drum, snook, and grouper, during charters, in compliance with FWC regulations.

Booking and Operational Policies

1. Charter Agreement: All charters are governed by a written agreement outlining the terms of service, including passenger limits, safety protocols, and cancellation policies.

2. No Refund Policy: All bookings are final. Cancellations or no-shows will not receive refunds. Rescheduling may be offered at the company's discretion, subject to availability and notice requirements.

Return and Refund Policy

At Rylax Yacht Charters, all bookings are final. By confirming your reservation, you agree to the following return and refund terms:

1. No Refunds

We maintain a strict no refund policy on all charter bookings. This includes, but is not limited to:

Guest cancellations for any reason
Scheduling conflicts
Missed departures
Weather-related changes not deemed unsafe by the captain
Acts of God, illness, or travel disruptions

2. Rescheduling

While we do not offer refunds, we may allow rescheduling of your charter under certain circumstances and with advance notice. Any reschedule request is at our sole discretion and must be submitted in writing to charter@rylaxyacht.com.

3. Weather & Safety

The safety of our guests and crew is our top priority. If the captain determines that weather or sea conditions are unsafe, we will make every effort to reschedule your trip. If rescheduling is not possible, your payment will be held as credit for future use.

4. No Show Policy

Failure to arrive at the scheduled departure time will result in cancellation without refund or reschedule credit.

5. Final Sale

All transactions are considered final sale. By booking a charter, you agree to this policy in full.
